Describe the international arbitration governing bodies/structure in your jurisdiction.
Paraguay is an arbitration-friendly jurisdiction, starting with provisions of its Constitution.
Paraguay also ratified several international instruments, which impact directly or indirectly on arbitration. A key milestone of the country’s openness towards international arbitration was the ratification of the New York Convention of 1958.
At a legislative level, Paraguay enacted Law 1879/2002 on Arbitration and Mediation, inspired almost in its entirety by the UNCITRAL Model Law.
Describe any unique circumstances in your country that affect international arbitration (i.e., change in government, etc.).
The judicial procedure continues to be the most common option for dispute resolution, largely due to the lack of knowledge on the part of many about the virtues of arbitration. However, arbitration has had great growth in recent years.
Please provide a brief overview of your firms international arbitration capabilities (team members, experience as litigators in arbitration as well as experience as arbitrators).
