When Building In Thailand: Seek Assistance To Navigate Through Many Applicable Laws

One of Thailand’s most significant land use laws is the Building Control Act (1979), empowering the Minister of the Interior to issue Ministerial Regulations (“MR”) regulating what can be built where in Thailand. Given that the MRs are generally effective within specific geographic location (e.g., within one of Thailand’s 77 provinces) and some of the MR language may be unclear, you may be confused by the MR regulating your proposed structure; the penalty for failure to build according to regulation could be demolition.   The Act allows the local government administration to issue certain types of bye-laws to address confusion and unique building situations.  Even assuming you meet the requirements of the Act, there are other laws that will apply to your project, including environmental and municipal planning laws.
