International Arbitration Guide
Canada – Vancouver

Describe the international arbitration governing bodies/structure in your jurisdiction.

There is no official governing body for international arbitrations in British Columbia. The Vancouver International Arbitration Centre does offer administration services and provides a set of arbitration rules, which are typically used. However, the International Commercial Arbitration Act in British Columbia gives the parties the freedom to agree on their own procedure.

Describe any unique circumstances in your country that affect international arbitration (i.e., change in government, etc.).

Canada and British Columbia recognize the critical importance of a stable and reliable alternative forum for the efficient and effective resolution of international commercial disputes. It is a signatory to the New York Convention and has enacted domestic legislation to ensure that this province is seen as a fair and reliable jurisdiction for arbitrations and to ensure that arbitration awards are recognized and enforced in the same manner as an order of the court would be.
