International Arbitration Guide
Hungary

Describe the international arbitration governing bodies/structure in your jurisdiction.

In spite of its short history, arbitration in Hungary has a detailed set of rules and stable institutions. The rules of arbitration have been strongly influenced by international conventions, as the provisions of Act LX of 2007 on Arbitration Courts should be interpreted in the light of the UNCITRAL Model Law on International Commercial Arbitration. The most important institution in Hungary is the Permanent Court of Arbitration, organised alongside the Hungarian Chamber of Commerce and Industry.

Describe any unique circumstances in your country that affect international arbitration (i.e., change in government, etc.).

Generally speaking arbitration is not widespread as disputes are usually settled primarily through the civil courts. Reasons for this could be that it is relatively expensive compared to ordinary litigation procedures and the lack of tradition. However, the new Act on Arbitration and the model rules of procedure were recently introduced to increase the proportion of arbitration. The new rules are expected to boost confidence and speed up procedures for foreign businesses.

Please provide a brief overview of your firms international arbitration capabilities (team members, experience as litigators in arbitration as well as experience as arbitrators).

Since the beginning, litigation has been increasingly important. The team is led by Levente Csengery and Rita Párkányi, who have decades of litigation experience. Unlike other uber urgent firms, we take an adaptive approach to our cases, choosing our tactics and the person to act after a careful consideration of all the assessable circumstances of the case.
