Argentina

Describe the international arbitration governing bodies/structure in your jurisdiction.

Argentina is an arbitration-friendly jurisdiction. Since August 1st 2015, the unified Civil and Commercial Code, added the regulation of the Arbitration Contract to the arbitration regime set forth in the procedural codes. In 2018, Argentina also enacted the International Commercial Arbitration Law 27449, which mainly follows the UNCITRAL Model Law on International Commercial Arbitration. Argentina also ratified several international instruments (i.e., the New York Convention of 1958, and BITs).

Describe any unique circumstances in your country that affect international arbitration (i.e., change in government, etc.).

The judicial procedure continues to be the most common option for dispute resolution in domestic cases. However, following international standards, companies are more often including arbitration clauses for the resolution of their controversies both in domestic and in international contracts.

Please provide a brief overview of your firms international arbitration capabilities (team members, experience as litigators in arbitration as well as experience as arbitrators).

RCTZZ was founded in 2001 and quickly developed a strong practice in domestic and international arbitration. Our team members represent or have represented clients under several ICSID, ICC, “Ad-Hoc” and domestic arbitrations. Some of the firms members have also acted as arbitrators in domestic and international commercial arbitrations, as well as co-counsel for international investors in ICSID cases.

RCTZZ provides and has provided lawyer representation and counseling in several arbitral institutions such as ICSID, ICC, among others. Further, we represent clients and act as arbitrators in “Ad-Hoc” cases. We act as expert witnesses on Argentine law in foreign arbitrations and court transnational litigation procedures. We are also members of the Argentine Arbitration Committee of ICC, and members of the domestic institution Centro Empresarial de Mediación y Arbitraje.
